What are the Fannie MAH and Freddie TAH affordable executions and how do sponsors qualify?

Eligibility and structural mechanics

Eligibility: properties with recorded affordability restrictions covering 20% or more of units at defined AMI thresholds. Common qualifying restrictions: LIHTC (low-income housing tax credit), HUD Section 8 project-based contracts, project-based voucher (PBV) contracts, state or local affordability LURAs, and inclusionary zoning restrictions that meet defined thresholds.

Documentation: requires the affordability restriction document (LURA, Section 8 HAP contract, PBV contract) plus underwriter validation that the restriction is enforceable and durable for the loan term. Properties with expiring affordability restrictions during the loan term may not qualify or may qualify only with renewal commitments.

Practical sponsor moves: many sponsors with mixed-income properties qualify for MAH/TAH but do not realize it. Properties with 20%+ LIHTC units, even if the LIHTC compliance period is partway through, typically qualify. Properties with state or local inclusionary zoning units sometimes qualify depending on the structure of the restriction.
