SBA 7(a), owner-occupied CRE

Single-loan owner-occupied execution. Faster than 504, more flexible, with one closing, but the lender options is the entire deal.

What does SBA 7(a) finance?

Owner-occupied real estate where the operating business uses 51% of the building (existing buildings) or 60% (new construction). Acquisitions, refinances of existing CRE debt, business acquisitions that include real estate, and improvements all qualify. Per the SBA SOP 50 10, 7(a) is the most flexible SBA program and the broadest bench of participating lenders, banks, credit unions, and a small group of non-bank Preferred Lenders.

Loan amount caps at $5 million per the SBA 7(a) program. Combined with 504 (which has a $5.5M SBA-debenture cap and a typical $15M+ project max), most owner-occupied deals under $15M go 7(a) or 504; over that, conventional bank or specialty owner-user lenders take over. The single biggest controllable factor in 7(a) execution is the lender. Preferred Lenders close in 60 to 90 days; non-PLP banks routinely take 120 to 180 days.

How does 7(a) compare to SBA 504?

504: two loans, two closings, two amortizations. The bank loan (typically 50% LTC) plus the CDC debenture (40% LTC) plus 10% sponsor equity. The CDC debenture is a 25-year fixed long bond at sub-7% rates in 2026. 504 wins on real-estate-only acquisitions where the borrower wants the long fixed bond. 7(a) wins on multi-purpose packages, faster closings, and where the borrower needs working capital alongside real estate.

What does 2026 pricing look like?

Guaranty fee: SBA charges an upfront guaranty fee on the SBA-guaranteed portion (typically 75% of loan), set on a sliding scale by loan amount (currently 0% to 3.5% per SBA fee schedule). Fee is funded into the loan or paid at closing. Other transaction costs: bank origination (typically 0.5% to 1.0%), appraisal, environmental, title, and closing legal.

What can prevent a 7(a) owner-occupied loan from closing?

Personal financial statement and global cash-flow underwriting. SBA requires personal guaranty from any 20%+ owner, full personal financial statements, and a global cash-flow analysis combining business and personal cash flow. Sponsors with lifestyle business cash flow disclosed on K-1s but not in the bank account get repriced or declined at SBA underwriting even when the property pencils.

Owner-occupancy compliance. The 51% (existing) or 60% (new construction) owner-use threshold must be documented and maintained. Tenant rent from third parties is permitted up to the cap; over the cap and the loan converts to non-eligible. Lenders verify occupancy at closing and at periodic SBA audits. Sponsors who plan to under-use the property or sublease aggressively should structure differently, conventional bank or 504 with a different occupancy structure.

Frequently asked questions

What is the SBA 7(a) loan cap?

$5 million per the SBA 7(a) program (gross loan amount, including the SBA-guaranteed portion). For owner-occupied CRE projects above $5M, the path is typically SBA 504 (which combines a bank loan with a CDC debenture for projects up to ~$25M+) or conventional bank.

Can I refinance my conventional bank loan into SBA 7(a)?

Yes, subject to SBA refinance rules under SOP 50 10. The new loan must produce a substantial benefit to the borrower (typically a 10%+ debt-service savings or other material improvement), and the refinanced debt must have been used for a 7(a)-eligible purpose. Several specialty Preferred Lenders focus on 7(a) refis and execute efficiently when the package fits.

How long does a 7(a) loan take to close?

60 to 90 days with a Preferred Lender on a clean file (full personal financials, business financials, business valuation if a business acquisition is included, environmental scope confirmed, appraisal ordered early). Non-Preferred Lender executions routinely run 120 to 180 days because they require SBA case-by-case approval rather than the lender's PLP authority.

Are 7(a) loans variable or fixed rate?

Most are variable, prime rate plus 2.25% to 2.75% on real-estate-secured loans, adjusted with prime moves. A handful of Preferred Lenders offer fixed rate via swap into a 5-, 7-, or 10-year fixed period, typically 25 to 50 bps above the comparable variable. For long fixed-rate certainty, SBA 504 is usually the better answer.
