How do Florida Citizens and Texas TWIA commercial coverage work?

Short answer

Florida Citizens and Texas TWIA are state-backed residual markets covering coastal commercial property where the admitted market won't write. Both have per-policy limits well below typical CRE values (TWIA's commercial maximum limit of liability is $4.424 million for structures and contents. Florida Citizens commercial building coverage is quoted to $2.5 million, and replacement-cost limits can be individually rated above that, up to $20 million per building), require admitted-market diligent-effort declinations, and trigger assessment exposure. Lenders accept them only as a base layer with substantial private excess coverage stacked above.

How residual markets fit into a CRE insurance program

Florida Citizens Property Insurance Corporation and the Texas Windstorm Insurance Association (TWIA) are statutorily created residual property insurers covering wind and named-storm risk in defined territories where the admitted market has retreated. Both are governed by state legislation and supervised by their respective state insurance regulators.

Both have meaningful eligibility constraints for commercial property: documented declinations from a defined number of admitted-market carriers (Florida Citizens diligent-effort rule; TWIA admitted-market test), per-policy coverage caps TWIA's commercial maximum limit of liability is $4.424 million for structures and contents. Florida Citizens commercial building coverage is quoted to $2.5 million, and replacement-cost limits can be individually rated above that, up to $20 million per building, and exposure to post-event policyholder assessments where catastrophe losses exceed surplus.

Lender treatment: residual-market wind is typically accepted as a base wind layer only, with an excess wind policy from a private specialty carrier (a London market syndicate or a domestic E&S carrier) stacked above to reach full replacement cost. The mortgagee clause must be properly endorsed on both the residual-market base policy and each excess layer, a frequent closing-checklist failure point.

Pricing has hardened materially in both Florida and Texas through 2023 to 2026 reform cycles. Florida SB 2-A (2022 special session) and follow-on legislation reformed Citizens and the Florida property market broadly; TWIA underwent reinsurance program restructuring after the 2017 Harvey loss cycle. Both markets remain in transition; sponsor-side counsel and a coastal-experienced broker are essential.
