How does the §179D energy-efficient buildings deduction interact with CRE debt placement?

Short answer

The §179D deduction provides up to a defined per-square-foot deduction for qualifying energy-efficient improvements to commercial buildings. The deduction is taken at the owner level (or allocated by government building owners to designers) and does not affect loan sizing. It can help underwrite higher-efficiency cap -ex that reduces operating expenses.

Where §179D fits in the capital stack and what changed under the IRA

This page is sponsor-POV process commentary, not tax or legal advice. Bring a CPA and tax counsel onto every transaction before relying on any of the mechanics described below.

Section 179D was made permanent by the Consolidated Appropriations Act, 2021. The Inflation Reduction Act increased the per-square-foot amount and tied the higher amount to prevailing-wage and apprenticeship requirements. Eligible buildings can claim a per-square-foot deduction for qualifying envelope, HVAC, and lighting improvements that meet ASHRAE-defined energy-savings thresholds.

Lender impact: the deduction is sponsor-side and does not change loan sizing, NOI, or DSCR. Where it matters operationally is on the cash flow at the sponsor level, meaningful first-year deductions reduce taxable income, which improves after-tax IRR. The deduction is most material on large floor plates (industrial, office, large multifamily) because the per-square-foot calculation scales with building size.

Energy-related cap-ex: agency Green Rewards and similar lender programs reward documented energy savings with pricing concessions and underwriting credit for projected expense savings. §179D deductions and Green Rewards underwriting credit are stackable, the same envelope and HVAC scope can drive both lender pricing benefits and sponsor tax shelter.

Practical placement note: the §179D allocation paperwork for government building designers is administratively heavy and best handled by a tax credit specialist. For private-sector sponsors, the deduction flows through to the partnership return and to investor K-1s. Lender packages should not lean on §179D for sizing or DSCR; the deduction is upside, not collateral.
