The California FAIR Plan is the state-administered residual property insurer for assets the admitted market declines. Commercial coverage is limited to named perils (fire, lightning, smoke, internal explosion) at per-location limits typically capped well below CRE replacement values. Lenders accept it only as a base layer with private DIC (difference-in-conditions) excess stacked above.
FAIR Plan mechanics and how lenders treat it
The California FAIR Plan Association is a private, state-mandated insurance pool established under California Insurance Code. Membership is required of every admitted property insurer in California; the pool provides last-resort property coverage when the admitted market declines a risk. The pool is supervised by the California Department of Insurance.
Commercial FAIR Plan coverage is named-peril only, typically fire, lightning, smoke, internal explosion. It does not cover liability, theft, water damage, or business interruption in the standard form. Per-location commercial limits are capped well below most CRE replacement values; aggregate program coverage may also be capped.
Lenders treat FAIR Plan as a base layer only. A difference-in-conditions (DIC) policy from a specialty market is required on top to broaden coverage to all-risk and to extend limits to full replacement cost; the DIC policy also typically provides business interruption / rental value, ordinance or law, and other coverages the FAIR Plan does not include.
The mortgagee clause attaches to both the FAIR Plan policy and the DIC layer, a frequent closing failure point. Loss settlement on a covered claim is split between the two policies per the policy language; counsel review of both forms is prudent before closing on a CA FAIR Plan-fronted asset.
